Linda
Galessiere joined Mclean & Kerr LLP
in February of 2007, having previously been a partner in the litigation
department of a major Toronto Law firm. Her practice primarily focuses on
corporate commercial litigation, property leasing disputes and retail
bankruptcy/ insolvency matters and environmental litigation.
In
advising clients regarding corporate commercial matters, Linda regularly
litigates and resolves issues arising from commercial contracts, including
purchase and sale of asset/share agreements and shareholder and joint venture
agreements. Linda has also represented clients before the courts in
multi-party creditor disputes as well as proceedings regarding oppression
remedies brought on behalf of minority shareholders.
Linda
also advises and litigates on behalf of commercial landlords and tenants
regarding all matters arising out of leasing contracts including the
interpretation and enforceability of leases, termination and repudiation of
leases, proper distress procedures and environmental issues. Linda regularly appears before the
Ontario Commercial Court in retail bankruptcy and insolvency proceeding
representing landlord interests. Most recently Linda has represented
Landlords in connection with insolvency proceedings regarding Bombay Furniture,
Athletes World, Cotton Ginny, Hoop/Disney Stores, Music World, Zacks, Mariposa
Stores, Saan Stores and InterTAN /Circuit City. Linda was also involved with the committee drafting
amendments to the current model insolvency orders regarding landlord concerns.
In
addition, Linda's practice includes representing both employers and employees
regarding all issues relating to employment law and a wide range of personal
injury/product liability matters.
Linda
is an experienced trial lawyer who has appeared before all levels of the
Ontario courts and the Canadian Federal Court of Appeal. She has also
represented clients before administrative tribunals and undertaken
judicial reviews of tribunal decisions.
She
was a Silver Medalist at the Ontario Bar Admission Course having been awarded a
Share of the Law Society First Prize, the Edwin George Long, K.C. Memorial
Scholarship and the Isadore Levinter Memorial Award for the student attaining
the second highest grades in the Ontario Bar Admission Course.
